for business on February 27, 1998. The parent company is Life, Education And Prosperity, Inc., a
Georgia corporation owned by Janet Wilson. Empowerism offers a low-cost subscription
to cutting edge Internet Marketing training and tools, along with an monthly online magazine called EXCELLENCE. Order Forms Our site uses an order form for customers to request information and to order products and services. Member Terms and Conditions
1. These Policies and Procedures apply to ALL Affiliates and Subscribers (sometimes collectively referred to as "Members"), except where specifically noted. A Subscriber is an Affiliate who buys an Empowerism subscription. 2. U.S. Affiliates must provide a Social Security or Federal Tax I.D. Number in order to be paid commissions. All Affiliates must be of legal working age in the state or country in which the Affiliate resides. 3. Empowerism allows ONE Affiliate position per Tax ID or Social Security number. Multiple subscriptions may be purchased by a single Affiliate for marketing or demonstration purposes. 4. Earned commissions are deposited into the Affiliate's Commission Balance, where any amount over $3.00 can be requested at any time. Commissions requested Sunday through Saturday are paid out no later than the following Wednesday by midnight Eastern time. Commissions are paid by Company Check, AlertPay, or e-Gold. A $3 fee is charged for each commission disbursement. Fast Start Bonuses are automatically paid every Monday (excluding national holidays) by Company Check, AlertPay, or deposited into the Affiliates Commission Balance and are based on sales made during the previous calendar week (Sunday through Saturday) at the rate of $20 per subscription sale. 5. Affiliates may choose to auto-deduct the following month's subscription renewal from commissions when the balance is more than $19.95 upon the close of month-end. Affiliates must indicate their auto-deduct preference inside their Member Center. 6. Affiliates are not required to purchase a subscription to participate in the compensation plan or receive commissions on subscription sales. To qualify for downline commissions on non-personal sales, an Affiliate must meet sales qualifications during the qualifying month. Qualifications are: $19.95 or more (which may include the Affiliate’s personal subscription renewal) to earn commissions on Levels 1 through 4, and $59 or more in personal sales or renewals (equal to 3 personal subscribers) to earn commissions on sales made on Levels 5 through 9 of the Affiliate's matrix. 7. If no subscription purchase, renewal, or personal sale is made by the Affiliate for a period of 90 days, the Affiliate is removed from Empowerism and any remaining downline is compressed. Affiliates may re-join at any time under the same sponsor or choose to wait a minimum of 60 days from cancellation to join under a different sponsor. 8. IRS 1099 forms are issued once a year before February 1 to Affiliates residing in the United States who earned commissions of $600 or more during the previous year. Affiliates are responsible for timely IRS reporting of income. 9. Fees: The first month's subscription fee is $29.95. This fee (minus any discount used) is refundable if a request to cancel is received by Empowerism via SUPPORT TICKET (online) OR IN WRITING (fax) within 72 HOURS of purchase. The monthly renewal fee is $19.95. Refunds on multi-month purchases are issued MINUS the full price ($19.95) of the months used. Renewals must be received by Empowerism no later than midnight Eastern on the last day of the month. 10. Subscription and membership fees may be paid by Visa®, MasterCard®, American Express®, Discover®, online check (U.S. bank only), personal check (U.S. bank only), cash, money order, International Postal money order, certified check (all US$), or the Internet payment methods known as e-Gold or AlertPay. 11. Empowerism will collect a $35 fee for charge disputes when the member has not contacted us first, a $30 fee for returned checks, a $15.00 fee for rejected bank debits, and a $50 fee for additional collection efforts. If a check or debit is returned, and the funds and fee are not replaced by the renewal due date, the Subscriber is considered Unpaid. All funds and fees must be paid in full within 30 days of rejection to avoid collection efforts. 12. WITHOUT EXCEPTION, SUBSCRIPTION CANCELLATIONS MUST BE RECEIVED BY SUPPORT TICKET (online) OR IN WRITING (fax or postal mail). Cancellations are NOT VALID until and unless acknowledged with a reply from an Empowerism employee, and the member should print or save the acknowledgement for future reference. Telephone/voice message cancellations are NOT VALID until and unless acknowledged IN WRITING by an Empowerism employee. When a cancellation is received after the LAST day of the month, auto-renewal will take effect that month. ANY DISPUTE OR QUESTIONS ABOUT CHARGES MUST BE REFERRED DIRECTLY TO EMPOWERISM AND WILL BE RESEARCHED IMMEDIATELY. Subscribers may NOT use the dispute of a charge to cancel a subscription. Disputed charges will incur a $50 collection fee plus $35 dispute fee. 13. A subscription is considered unpaid after one missed renewal. Unpaid subscriptions do not count toward commission qualification. 14. Acceptable Use Policy: Affiliates may not promote Empowerism or its products, nor use the Company name, trade names, logos, or copyrighted material, except in the format provided and/or approved by the company. Pre-approved marketing formats are included in the online Member Center. Affiliates are bound by the Empowerism Zero-Tolerance Spam Policy. Empowerism may terminate an Affiliate's account, without compensation, for AUP violation. 15. Affiliates may not make false or misleading statements about Empowerism, its product, or the opportunity. False statements include but are not limited to income guarantees and promises of income in exchange for no effort. Affiliates may not reveal confidential or proprietary financial information about the company without written consent of an officer of the company. 16. Affiliates may not knowingly solicit a non-personally-sponsored Empowerism Affiliate for another business/income opportunity. Violators may be removed from Empowerism at the company’s sole discretion. 17. Affiliates may access genealogy reports from the online Member Center. Any misuse of this feature will result in the termination of the Affiliate's status and forfeiture of any future commissions. 18. An active Affiliate, one whose Affiliate position has not been canceled or terminated by the company, may sell his or her Affiliate position to any qualifying party ONLY upon approval of an officer of the company. 19. Affiliates must conduct company business and act in the company's best interest at all times. Any public posting or expression of false or inflammatory statements will result in account termination, without exception, and possible legal consequences. 20. Empowerism expressly reserves the right to alter or amend prices, Policies and Procedures, product availability and compensation plan. Such amendments are automatically incorporated as part of the agreement between the Company and the Affiliate or Subscriber. 21. The company reserves the right to terminate the status of an Affiliate at any time for cause when it is determined that the Affiliate has violated the provisions of these policies as they may be amended or the provisions of applicable laws and standards of fair dealing. Such involuntary termination shall be made by the company at its discretion. Upon an involuntary termination, the company shall notify the Affiliate by email at the most current email address listed with the company. In the event of termination, the Affiliate agrees to immediately cease representing him/herself as an Affiliate. 22. The laws of the State of Georgia hereunder shall govern the terms and provisions of this Affiliate agreement and any dispute arising. Any litigation, claim, or lawsuit directly or indirectly arising out of or related to the Affiliate agreement, any terms thereof or the relationships created thereby shall be instituted exclusively in the courts, whether federal or state, located in the County of Fulton, Georgia. Any such litigation, claim or lawsuit as to which there is federal jurisdiction, by reason of diversity, federal question or otherwise, shall be instituted exclusively in the federal district court in Atlanta, Georgia.
